Terms of service
The rules for buying a resort stay from us. Plain English, because you should be able to read them before you spend two thousand dollars.
Updated
Draft for legal review. This text has not been read by counsel yet. It says what we intend to do; the wording is not final.
Who we are
This site is run by SONAMARKETING LLC, a Florida limited liability company at 2880 W Oakland Park Blvd, Suite 225C, Oakland Park, FL 33311, USA. The Caribbean Guys is our trade name. It is not a separate company.
In these terms, "we", "us" and "our" mean SONAMARKETING LLC. "You" means the person making the booking.
We are an independent booking site. We are not the official site of any resort, we are not owned by a resort, and we do not use resort logos.
Booking through this site means you accept these terms. If you do not accept them, do not book.
What we sell
We sell one thing: a hotel room. The room, the board that comes with it — usually all-inclusive — and the taxes on both. That is the whole product.
We do not sell:
- Flights.
- Airport transfers or any ground transport.
- Car hire, excursions, tours, cruises or timeshares.
- Travel insurance. We sometimes link to insurers because we think you should have cover. If you buy from them, that contract is between you and them, and we are not a party to it and earn nothing from telling you to get it.
Because we sell a single type of travel service and never combine it with a second one, what you buy here is not a package holiday and not a linked travel arrangement. The package-travel rules that apply to tour operators do not apply to a room sold on its own.
If you want a transfer or a tour, book it yourself, with a company you choose. We are happy to tell you what we used.
Who charges your card
The payment is taken by Nuitée Travel Limited, an Irish company registered in Dublin (company number 570685). Nuitée is the merchant of record for your booking: they take the money, they hold it, they send the booking to the resort, and they issue any refund.
Your card statement will read "Nuitée Travel Limited", not "The Caribbean Guys". If you see that line and do not recognise it, that is your stay with us.
We tell you this on the payment screen, before you pay, so it is never a surprise on a statement three weeks later.
Your card details are typed into Nuitée's own payment form, inside our page. The card number never reaches our servers and we never store it. Some banks will ask you to confirm the payment in your banking app — that is 3-D Secure, and it is normal.
Nuitée's own terms apply to the payment itself. These terms govern everything else: what we told you about the resort, the price we showed you, and getting your booking right.
Prices, and what "all-in" means
Every price on this site is one number, in US dollars, for the whole stay you searched — all the nights, all the guests, all the taxes, all the fees. It is the biggest number on the screen, and it is the number you pay.
What is inside the total
- The room rate for every night.
- The board — all-inclusive where the rate says all-inclusive.
- Every tax and service charge the resort or the government applies to the room.
- Any mandatory fee the resort collects at check-in.
Some resorts collect part of the tax at the desk rather than in advance. When that happens we say so on the same screen, in this form: "Resort taxes paid at the hotel: $84 — inside this total." That $84 is already inside the number you agreed to. You are not paying it twice, and the total is not smaller than what you will actually hand over.
What is not inside the total
- Anything you choose to buy at the resort: the spa, a paid restaurant, a premium bar, the minibar if your rate does not include it, tips.
- Excursions, transfers and anything else you book with someone else.
- Anything a government charges you personally at the border — a tourist card, a departure tax, a visa.
- Your bank's foreign-exchange fee, if your card is not a US dollar card. Prices are charged in USD; your bank converts and may add its own fee. That fee is theirs.
Prices move. A price you saw yesterday, or a price in one of our ads, is not a booking. The price becomes fixed when the payment goes through, and not before.
If a price on the site is obviously wrong — a five-night all-inclusive stay for $12 — we may cancel the booking and refund you in full rather than honour it. We will tell you the same day.
Making a booking
You must be 18 or older and able to enter into a contract.
Give the real name of every guest, exactly as it appears on the passport they will travel with. A wrong name can mean the resort refuses the room at the desk, and whether it can be fixed is decided by the rate's own rules, not by us.
Give an email address you actually read. Everything about your stay goes there — the confirmation, the cancellation deadline, any change.
The price hold
When you go to pay we hold the rate while the payment is authorised. That hold is short, usually a couple of minutes, and there is a timer on the screen. If the payment fails or the hold runs out, nothing is booked and nothing is charged. Start again and the price will be whatever is live at that moment.
Occasionally the resort changes the price between the moment you picked the room and the moment you pay. When that happens we stop, show you the new number, and ask again. We never charge a different number than the one on the screen you agreed to.
A booking exists when our confirmation email reaches you — not when you press the button.
Your confirmation
You get a confirmation email straight away. It carries your booking reference, the resort, the dates, the room, the guest names, the total you paid, and the cancellation deadline written out in words.
The resort's own confirmation number sometimes arrives with it and sometimes a few hours later, because it is generated on the resort's side and passed back to us. Your booking is valid either way: the reference on your confirmation is enough to check in.
If the resort's number has not appeared within 48 hours, email us with your reference and we will chase it.
Take the confirmation with you, on your phone or on paper. It is what you show at the desk.
Cancelling
Every rate carries its own cancellation rule. We print that rule as a sentence next to the price, before you pay — never as a footnote, never in small type.
Free cancellation until 3 December 2026, 23:59 resort time. After that the stay is non-refundable.
- Refundable rates can be cancelled free until the stated date and time, in the resort's local time. After that moment they are not refundable.
- Non-refundable rates cannot be cancelled for a refund at any point. They are usually cheaper, and that is what the lower price buys.
Refunds go back to the card that paid, issued by Nuitée Travel Limited, and normally land in 5 to 10 business days. The full detail, including how to press cancel, is on our cancellation and refund policy.
Changes to your booking
Dates, room type and the number of guests cannot be edited after booking. To change any of them we cancel the booking and make a new one. That only works if the rate is refundable and still inside its free-cancellation window, and the new stay costs whatever is live that day — which may be more.
A misspelt guest name we will try to fix, free. The resort decides whether it can be done.
Special requests — a high floor, a late arrival, adjoining rooms, a quiet room, a birthday — are passed to the resort and are never guaranteed. A request that is not honoured is not grounds for a refund.
If you need a wheelchair-accessible room, a medical fridge or anything else you cannot travel without, tell us before you book. We will confirm it with the resort in writing first.
No-shows and leaving early
If you do not arrive, the resort keeps the money and there is no refund.
If you leave early, the nights you do not use are not refunded.
That is the resort's rule and it applies to refundable rates too, once the stay has started. The free-cancellation window ends before check-in for a reason.
At the resort
We sold you the room. The resort provides the stay, and once you are there the resort's own rules apply: check-in and check-out times, minimum ages at adults-only resorts, dress codes in the à-la-carte restaurants, deposits, damage.
Some things a resort advertises are seasonal, and some are under repair. If a pool, a restaurant or the spa is closed while you are there, tell the front desk first — they can sometimes fix it in ten minutes and we cannot. Then tell us. It goes in the review.
You are responsible for your own passport, visa, entry card, vaccinations and insurance. We do not check them and we cannot refund a stay you could not reach.
Our reviews and scores
Every review on this site describes a stay one of us actually slept through. We paid for those stays with our own money, through a normal booking channel, and each review page says what we paid and when.
Where a resort invited us and did not charge us, the page says so at the top, in the same size type as everything else. One stay on the site is an invited stay today, and it carries that line.
Scores are opinions. They come from what we saw on the dates we were there. A resort can be repainted, resold or re-staffed the week after we leave. We never score value for money, because that is the verdict's job, not a number's. A score is not a promise about your stay and it is not part of what you are buying.
Photos and video on a review page are ours, taken on the stay the page is about. Room photos, and photos of resorts we have not slept in, are supplied by the resort and come from the booking feed; each one says so in the image description its markup carries, which a screen reader reads out. We do not take money for a score, a ranking or a place in a list, and no resort sees a review before it is published.
Our text, photos, video and scores are ours. Do not republish them.
The members' rate
Some rates are lower than the public price. Those sit behind our email list, because the resorts let us show them to a closed group and not on an open page. That is a supplier rule, not a marketing trick.
Joining is free: give us an email address and the rate appears. We send about one email a month and there is an unsubscribe link in every one.
A members' rate carries the same all-in total, the same cancellation sentence and the same refund route as any other rate on the site.
What we ask of you
- Use the site to look at resorts and book rooms.
- Do not scrape it, resell our prices, or copy our photos, reviews or text.
- Do not use our name or our brand for anything.
- Do not book with a card that is not yours.
- Do not use the site to break the law.
We can refuse or cancel a booking that looks fraudulent. If we cancel one, we refund it in full.
What we are responsible for
We are responsible for selling you the room we described, at the price we showed, and for getting your booking to the resort correctly. If we get that wrong, we fix it or we refund you.
We are not the resort and we do not run it. We are not responsible for:
- The resort's service, food, cleanliness, staffing, closures or overbooking.
- Injury, illness, loss or theft on the resort's property.
- Weather, hurricanes, seaweed, flight delays, airline strikes, border rules, visas or vaccination requirements.
- Anything you buy from a third party we linked to, including travel insurance.
Nothing in these terms limits liability that cannot be limited by law — including for fraud, or for death or personal injury caused by our negligence. Subject to that, our total liability for any booking is limited to the amount you paid us for that booking, and we are not liable for indirect or consequential loss, including a missed holiday, a lost deposit elsewhere, or lost earnings.
The site itself is provided as it is. We work hard to keep the resort facts accurate, but a facility list, a photo or a price can be out of date, and that alone is not a breach of these terms.
Governing law and disputes
These terms are governed by the law of the State of Florida, without regard to its conflict-of-laws rules.
Any dispute goes to the state or federal courts sitting in Broward County, Florida, and we both agree to those courts. Your stay is in the Dominican Republic and the seller is in Florida, so this is not a service supplied in your own country.
If you are a consumer somewhere with mandatory local protection that cannot be contracted away, that protection still applies. Nothing here takes away a right the law where you live gives you anyway.
Before any of that: email us. Almost everything is a misunderstanding that one email fixes. If you are thinking about a card chargeback, talk to us first — a chargeback on a booking we would have refunded anyway costs everybody weeks.
Contact and complaints
hello@thecaribbeanguys.com. One of the three of us answers, usually within a working day.
Put your booking reference in the subject line. We do not run a phone line — email is the only route, and it is the one we actually read.
If a disputed booking has to go back through Nuitée, their own complaints handling runs 5 to 20 working days. We chase it every few days and tell you where it is rather than leaving you to wonder.
If your stay is in progress and something is wrong, tell the front desk first, then email us.
Changes to these terms
We update this page when the business changes. The date at the top is the date of the version you are reading.
The terms that apply to your booking are the ones that were on this page the day you booked. We keep a copy of every version and will send you yours if you ask.
